My roommate left me with all the bills in his name can I simply cancel them without his approval?


My ex-roommate has up and left me with 6 months left on a 12 month lease because he claimed his brother was ruining his life. Anyways, he still has a key to the apartment and also to the mail box. He is known for playing games as he didn't pay his portion of the rent before he vanished either. So I just want to make sure that I get the bills in my name as soon as possible so that they can actually be paid. His name is still on the lease but I informed the management that he vacated and that I have another roommate ready to sign papers and move in. Would I have to wait until the new lease is finalized or do I now have complete control over decisions of the rental property and would thus be able to obtain my own electric company? How would I cancel the old electric if so?
My name is on the lease. The management told me all my new roommate would have to do is pay a $50 application fee. How wouldn't he have broke the lease by vacating and not paying his portion of the rent?

I deal with tenant/landlord issues all the time. You said YOUR name is on the lease. The only way your "roommate" is responsible for rent is if HIS name is on the lease as well.

Many people misunderstand what it means by having your name on the lease. A lease is a contractual obligation. In order to make your "roommate" responsible for anything is to sign the lease JOINTLY. There is a process where apartments say they are "adding them to the lease", but in reality, are only listing them as a resident. TWO COMPLETELY separate things. When you are entering a roommate situation where it is agreed that you are to pay half of the rent, it must be communicated as such when entering the lease, otherwise, they are going to take the lazy way out and just "add them". Each roommate must individually initial and sign the lease. Each roommate must be responsible for his/her half of the rent meaning each person pays their half directly to the landlord. None of this giving his/her half to the most responsible to write out a check for the whole amount.

It sounds like you were the only one to "sign" the lease; therefore it is your sole responsibility to pay the entire amount regardless of who is living in the apartment. What you, and many others, fail to realize is the "contractual" relationship. The lease was only signed by you and therefore you are the only one in a contract with the apartments. They can care less about your roommate as long as they have full liability from you. If you ever want to see the unpaid rent amounts, you will have to prove in small claims court that you had an agreement with your ex-roommate and he bailed.

As for the utilities, you will need to contact them directly. That is a whole separate issue and they are the only ones that will be able to help you.
