Police damaged landlord's property serving a warrant?
I have a rental property rented to a tenant. My tenant's son had friends over to play video games. Unfortunately, those friends were crack dealers. The police observed them going into my property, got a warrant, and shot out my windows and busted down my front door. Neither I, nor the tenant are involved with drugs or crimes. How can I get restitution for the damage caused by the police? (I am in Ohio)
I understand warrants are needed and damage may occur, but, it doesn't make sense that the government doesn't pay for the repairs? I didn't break the law, and even my tenant didn't break the law, why should I be left holding the bill?
You will have to seek restitution from your tenants.
The police are not liable. They have Sovereign Immunity.
You may want to make a criminal background check a part of your tenant screening process. I doubt your tenants are good upstanding law abiding innocent people who just happen to be good friends with drug dealers. Birds of a feather flock together.
And no....your insurance policy will not cover it. It specifically excludes damage caused by government action. And as soon as your insurance company finds out you rent to drug dealers....there is a good chance you will be invited to get insurance with another company (i.e. ....dropped).
